Eminent Domain/Inverse Condemnation

Government or regulatory condemnation of residential, agricultural, industrial, or business property can have enormous impact on the financial interests of property owners. When facing an action of this type, our first step is to help our clients decide whether accepting the offered compensation for the property is in their best interest. If not, we can negotiate or, when necessary, litigate with the government regarding its right to take the property. We scrutinize the public purpose of the proposed acquisition, bad faith negotiation issues, the amount of compensation, the form of payment, and whether additional compensation such as temporary business damages or severance damages are warranted.  Our attorneys have knowledge of the public entities involved; and, with the assistance of competent consultants, including engineers, appraisers, and land use planners, we strive to meet our clients' goals of minimizing property loss and maximizing compensation.
