Mortgage Financing

Both local and out-of-state lenders look to us for representation in connection with commercial and residential loan transactions. We work with our lenders including CypressCoquina Bank, Colonial Bank, Peoples First Community Bank, SunTrust Bank and Bank of America from the initial loan commitment through the closing and post-closing follow up. As an agent for several title underwriters, we can provide the title insurance required in a loan transaction. Our experience includes construction and permanent financing, land acquisition loans, revolving credit facilities and loan workout negotiations.

We can handle loan foreclosures for both residential and commercial properties. While prosecuting mortgage foreclosures for our clients, we track the foreclosure process all the way to the public auction to ensure that our clients’ financial interests are protected.

Residential Real Estate

Florida will continue to experience a boom in residential real estate development fueled by the population growth and economic strength in these areas. Our clients include developers of residential projects as well as residential contractors, lenders and brokers. Our title division is headed by real estate attorneys and staffed by professionals.  We also represent individuals in the sale and purchase of personal residences. Section 1031 Exchanges

These like kind exchanges of real property pursuant to Section 1031 of the Internal Revenue Code can be a valuable tool to defer or avoid capital gains tax on real estate transactions. Section 1031 allows a business and/or investment property owner to sell one property and purchase another while deferring the capital gains/income taxes on the transaction.   Caution must be exercised when structuring these transactions for the taxes to be deferred as you must assure that the requirements of Section 1031 strictly met.
